Why Estate Planning Documents Need Regular Review

Many individuals complete their estate planning documents and assume the process is finished.

In reality, estate planning requires periodic review. Over time, personal circumstances, family relationships, and financial structures evolve. When estate planning documents remain unchanged while these factors shift, the distribution framework may no longer reflect the individual’s intentions.

Family changes are among the most common reasons for reviewing estate plans.

Marriage, divorce, the birth of children or grandchildren, and changes in family dynamics can all affect how individuals wish their assets to be distributed. Estate plans should be updated to reflect these developments.

Changes in financial circumstances may also require adjustments.

Business ownership, real estate acquisitions, and investment growth can alter the structure and value of an estate. When the composition of assets changes significantly, the estate plan may need to be revised to ensure the distribution structure remains appropriate.

Beneficiary designations should also be reviewed regularly.

Financial accounts, retirement plans, and life insurance policies often transfer according to beneficiary forms rather than the will. Periodic review helps ensure these designations remain aligned with the broader estate plan.

Fiduciary appointments should be reconsidered as well.

Executors and trustees must be capable of fulfilling their responsibilities. As time passes, the individuals originally selected for these roles may no longer be able or willing to serve.
